This website is operated by CuraCards. Throughout the site, "we", "us" and "our" refer to CuraCards. We offer this website — including all information, tools and services available on it — to you on the condition that you accept the terms, conditions, policies and notices set out here.
By visiting our site and/or purchasing from us, you are using our "Service" and agree to these Terms & Conditions ("Terms"), including the additional policies referred to here or linked from this page (such as our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy and Pre-Order Policy). These Terms apply to everyone who uses the site, including browsers, customers and anyone who submits content.

New features or tools added to the store are also covered by these Terms. You can view the current version at any time on this page. We may update these Terms by posting changes on our website; changes apply from the date they are posted and will not affect orders already placed.
Our online store is powered by Shopify. Shopify provides the e-commerce platform, hosting and checkout that allow us to sell our products to you.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded.

You must not transmit any worms, viruses or code of a destructive nature.

We may refuse service to anyone, for any lawful reason, at any time.
Payment card details are encrypted during transfer and are handled by our payment providers through Shopify's secure checkout — CuraCards does not store your full card details. Other content you send may pass over various networks and be adapted to meet technical requirements of those networks or devices.
You must not reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service or any contact on the website, without our express written permission.
Headings in these Terms are for convenience only and do not affect their meaning.
Section 3 – Accuracy, Completeness and Timeliness of Information
We work hard to keep the information on our site accurate and up to date, but we cannot guarantee that all material is complete or current at all times. Site content is provided for general information.
The site may contain historical information that is not current and is provided for reference only. We may change the content of the site at any time.
Section 4 – Changes to the Service and Prices
Prices for our products may change without notice. The price that applies to your order is the price shown at checkout when you place the order.
We may modify or discontinue the Service (or any part of it) at any time. To the extent permitted by law, we are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
Section 5 – Products
Some products may be available only online and in limited quantities. Returns and exchanges are handled under our Return & Refund Policy.
We make every effort to display product colours and images as accurately as possible, but we cannot guarantee that your screen will display colours accurately.
We may limit the sale of products to any person, geographic region or jurisdiction, and may limit quantities, on a case-by-case basis. Product descriptions and pricing may change at any time. We may discontinue any product at any time. Any offer made on this site is void where prohibited.
Card condition descriptions, photos and grading information are provided in good faith to help you make an informed purchase.
Section 6 – Orders, Billing and Account Information
We may refuse or cancel any order. We may, at our discretion, limit or cancel quantities purchased per person, per household or per order — including orders placed using the same customer account, payment card, and/or billing or shipping address. We may also limit or decline orders that appear to be placed by dealers, resellers or distributors. If we change or cancel your order, we will try to contact you using the email address and/or phone number provided with the order, and if we cancel an order you have paid for, we will refund you in full.
You agree to provide current, complete and accurate purchase and account information, and to keep your account details (including your email address) up to date so we can complete your transactions and contact you when needed.

Section 7 – Optional Tools
We may give you access to third-party tools that we do not monitor, control or provide input into. These tools are provided "as is" and "as available", without endorsement. Your use of optional third-party tools is at your own discretion, and you should make sure you are comfortable with the terms on which the relevant provider offers them.
New services or features we offer through the website in future will also be subject to these Terms.

Links to third-party websites are provided for convenience; we are not responsible for their content or accuracy, or for products, services or transactions made through them. We may, but are not obliged to, monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.
You agree that your comments will not infringe anyone's rights (including copyright, trademark, privacy or personality rights), will not contain unlawful, abusive or obscene material, and will not contain any virus or malware. You must not use a false email address, impersonate anyone, or mislead us or others about the origin of your comments. You are responsible for the comments you make.

Personal information you submit through the store is handled in line with our Privacy Policy.
Section 11 – Errors, Inaccuracies and Omissions
Occasionally our site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct these at any time and, where an order was placed based on a clear error, we may cancel that order (including after it has been submitted). If we cancel a paid order for this reason, we will contact you and refund you in full.
Section 12 – Prohibited Uses
In addition to other restrictions in these Terms, you must not use the site or its content: (a) for any unlawful purpose; (b) to encourage others to carry out unlawful acts; (c) to breach any international, federal, state or local laws or regulations; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track other people's personal information; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service, any related website, other websites or the internet. We may end your use of the Service for breaching these restrictions.
Section 13 – Your Consumer Rights, Warranties and Limitation of Liability
Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits those rights.
Subject to those rights:
- We do not guarantee that the website will always be uninterrupted, timely, secure or error-free, and we may take the site offline for maintenance or other reasons.
- Except as expressly stated by us or as required by law, the website and its content are provided "as is" and "as available".
- To the maximum extent permitted by law, CuraCards (including our staff, contractors, suppliers and service providers) is not liable for any indirect or consequential loss, or for loss of profits, revenue, savings or data, arising from your use of the site or any product purchased through it.
- Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited (at our option) to replacing the goods or supplying equivalent goods, or paying the cost of replacing the goods or acquiring equivalent goods.
Section 14 – Indemnity
To the extent permitted by law, you agree to indemnify CuraCards and our affiliates, partners, contractors, service providers, suppliers and staff against any claim or demand (including reasonable legal costs) made by a third party arising from your breach of these Terms or the documents they incorporate, or your breach of any law or the rights of a third party. This indemnity is reduced to the extent any loss is caused by our own negligence or breach.
Section 15 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law and the unenforceable part will be severed. This does not affect the validity of the remaining provisions.
Section 16 – Termination
Obligations and liabilities incurred before termination survive termination.
These Terms apply until ended by you or us. You may end them at any time by telling us you no longer wish to use our Services, or by ceasing to use our site.
If you fail, or we reasonably suspect you have failed, to comply with these Terms, we may end this agreement and/or deny you access to our Services (or any part of them). You remain liable for any amounts due up to the date of termination.
Section 17 – Entire Agreement
If we do not exercise or enforce any right or provision of these Terms, that does not waive that right or provision.
These Terms, together with any policies or operating rules we post on this site in relation to the Service, form the entire agreement between you and us about your use of the Service, and replace any earlier agreements, communications or versions of these Terms.

These Terms, and any separate agreements under which we provide you with Services, are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
